Heartbreaking Discovery: 4-Year-Old Found Unresponsive in Closet Leads to Neglect Charges

There are losses that leave entire communities searching for answers. On March 23, Indianapolis police responded to a home in Marion County after a report of a child who was unresponsive. Officers found 37-year-old Angel Lovely attempting CPR on her 4-year-old son, Malachi Lovely.

The young boy had been in a small closet space under the basement stairs. Visible signs of distress were present, and Malachi had significant medical needs, including cerebral palsy and hip dysplasia. Paramedics rushed him to a hospital, but he was pronounced dead shortly after arrival.

Authorities say the child had not received proper medical attention leading up to the incident. Marion County Prosecutor Ryan Mears called the situation “absolutely devastating,” noting that children rely completely on caregivers for protection and support.

On April 1, Angel Lovely faced charges of two counts of neglect of a dependent resulting in death. Her 36-year-old boyfriend, Nicholas Bergdoll, was charged with two counts of neglect of a dependent resulting in serious bodily injury. Investigators allege both adults failed to provide the necessary care Malachi required due to his conditions.

Court records detail accounts from Malachi’s older siblings, who told detectives the boy had been kept in the confined space and that care had been inconsistent. One sibling discovered him unresponsive while the adults were asleep. The pattern of neglect, according to officials, created conditions that proved fatal for a child who needed constant supervision and medical support.

The case has drawn attention to the vulnerabilities faced by children with disabilities who depend entirely on adults. Experts note that conditions like cerebral palsy require regular therapy, monitoring, and prompt medical care—needs that were reportedly not met here.

Neighbors expressed shock, saying they had no idea of the extent of the situation inside the home. The surviving siblings are now in the care of family members or child protective services and are receiving support to help them process the loss.

Prosecutors continue to investigate, reviewing evidence and statements to understand the full circumstances. They stress that this remains an active case, with a focus on ensuring accountability and preventing future tragedies.

This heartbreaking event serves as a reminder of the critical responsibilities caregivers hold, especially for children with complex medical needs. Community members have organized memorials to honor Malachi’s short life and to highlight the importance of vigilance and reporting concerns about child welfare.

As Lovely and Bergdoll remain in custody awaiting further proceedings, officials say justice for Malachi remains the priority. While nothing can bring him back, the investigation aims to shed light on what happened and strengthen protections for other vulnerable children.

Malachi’s story, though filled with sorrow, has sparked local conversations about better support systems and awareness for families caring for children with disabilities. His memory lives on through his siblings and the renewed call to ensure every child receives the care and safety they deserve.
