Authorities say an 11-month-old baby, Basil Daly, was fatally shot by his own mother, Madaline Daly, who allegedly wanted to prevent her former partner from being part of the child’s life.

The heartbreaking incident unfolded in Silver City, where investigators say Daly fled with the baby while attempting to avoid court orders that granted shared custody to the child’s father, Jake Stoner.

What followed was nearly a year of escalating conflict, legal battles, and desperate attempts by a father to be part of his son’s life.

The relationship between Daly and Stoner had reportedly become unstable long before their child was born. By July 2024, the couple had separated following a volatile breakup.

When Basil was born in January 2025, Stoner hoped the child would bring some stability to their situation. Instead, the birth marked the beginning of a long and painful custody struggle.

According to investigators, Daly quickly attempted to cut Stoner out of the child’s life entirely. She allegedly moved to a new location and kept it hidden, making it extremely difficult for Stoner to see his son.

Determined not to lose contact with his child, Stoner began pursuing legal action.

He hired a private investigator and filed court petitions in an effort to establish parental rights and visitation.

After months of legal proceedings, the court eventually ruled in Stoner’s favor.

In the fall of 2025, he was granted shared custody of Basil. On paper, it meant the baby would spend time with both parents.

But prosecutors say Daly refused to cooperate.

Stoner later claimed she repeatedly blocked visitation attempts and ignored the court’s orders.

Court records also referenced a message Daly allegedly sent Stoner during the dispute:

“Awww, you snitched.”

Authorities say she first traveled to Worland, before continuing south toward New Mexico.

During this time, investigators believe Daly became increasingly paranoid and angry about the custody battle.

According to statements included in the case file, she reportedly made chilling remarks suggesting Stoner would never be allowed to raise the child.

Friends and investigators later described her behavior as increasingly desperate as the legal pressure mounted.

Meanwhile, authorities began tracking her movements in an effort to recover the child safely.

The case reached its tragic conclusion in December 2025.

Law enforcement received information that Daly and the baby were staying in an RV in Silver City, New Mexico.

But within moments, the situation spiraled out of control.

According to court documents, Daly allegedly pulled out a 9mm handgun while still inside the RV.

Then she fired a single shot.

The bullet struck Basil in the face.

The infant died instantly.

According to legal filings, she showed little immediate remorse and insisted she had acted out of concern for the child’s safety if authorities had forced her to surrender.

She also repeated accusations that Stoner had never truly cared for his son—claims that prosecutors say will be examined during the trial.

Daly has since been charged with first-degree murder and remains in custody as the case proceeds through the court system.

For Jake Stoner, the tragedy represents the devastating end of a long fight to be part of his son’s life.

Friends say he had spent months battling through the legal system just for the chance to hold his child.

Now, that opportunity is gone forever.

In the aftermath of Basil’s death, Stoner has spoken publicly about the need for changes to emergency alert systems, including Amber Alert procedures.
